In Canada, the main privacy law is the Personal Information Protection and Electronic Documents Act (PIPEDA). This law applies to all private-sector organizations that collect, use, or disclose personal information in the course of commercial activities.
Additionally, some provinces and territories have their own privacy laws that may apply. For example, the Alberta Personal Information Protection Act (PIPA) and the British Columbia Personal Information Protection Act (PIPA BC) apply to organizations that collect, use, or disclose personal information in those provinces.
Some key requirements that your privacy policy should address to comply with Canadian privacy laws may include:
- Disclosure: Your privacy policy should explain to visitors what personal information you collect, how you collect it, and why you collect it. You should also disclose any third parties with whom you share personal information.
- Consent: Your privacy policy should explain how you obtain consent from visitors to collect and use their personal information. Consent should be obtained before any personal information is collected, and visitors should be able to withdraw their consent at any time.
- Use and retention: Your privacy policy should explain how you use personal information and how long you retain it. Personal information should only be used for the purpose for which it was collected.
- Security: Your privacy policy should explain how you protect personal information from unauthorized access, use, or disclosure. You should take reasonable measures to protect personal information and ensure its confidentiality.
- Access and correction: Your privacy policy should explain how visitors can access and correct their personal information. Visitors should be able to request access to their personal information and have it corrected if it is inaccurate or incomplete.
- Accountability: Your privacy policy should explain who is responsible for ensuring compliance with privacy laws within your organization. You should designate a privacy officer or other individual to be responsible for privacy compliance.
